Duty of care also deals with the safety and wellbeing of students and children.  Briefly discuss the requirements for work health and safety and your duty of care as it relates to PCBUs and workers.

The requirements for work health and safety (WHS) and duty of care as it relates to Persons Conducting a Business or Undertaking (PCBUs) and workers are outlined in the Work Health and Safety Act.

1. PCBUs: The primary duty of care of a PCBU is to ensure, as far as is reasonably practicable, the health and safety of workers while they are at work in the business or undertaking. This includes providing and maintaining a work environment that is without risks to health and safety, providing adequate facilities for the welfare of workers, and providing any information, training, instruction or supervision necessary to protect all persons from risks to their health and safety.

2. Workers: Workers have a duty to take reasonable care for their own health and safety and to not adversely affect the health and safety of other persons. They must comply with any reasonable instruction given by the PCBU and cooperate with any reasonable policy or procedure of the PCBU relating to health or safety at the workplace.

In the context of schools, the duty of care extends to ensuring the safety and wellbeing of students. This includes providing a safe learning environment, supervising students adequately, implementing strategies to prevent bullying, and responding to any incidents or emergencies promptly and effectively.
