The Data Protection Act 2018 makes it illegal to:

  1. Process personal data without the individual's consent, unless there is a lawful reason to do so. This includes collecting, recording, organizing, structuring, storing, altering, retrieving, using, disclosing, or destroying personal data.

  2. Process sensitive personal data without explicit consent, unless there is a lawful reason to do so. Sensitive personal data includes information about an individual's racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic data, biometric data, health data, or data concerning a person's sex life or sexual orientation.

  3. Transfer personal data to a country or international organization outside the European Economic Area, unless the country or organization ensures an adequate level of protection for the rights and freedoms of data subjects in relation to the processing of personal data.

  4. Fail to notify the Information Commissioner's Office (ICO) within 72 hours of becoming aware of a personal data breach, unless the breach is unlikely to result in a risk to the rights and freedoms of individuals.

  5. Fail to provide individuals with information about the processing of their personal data, including the purposes for processing, the categories of personal data concerned, the recipients or categories of recipients of the personal data, and the rights of the individual in relation to the processing.

  6. Fail to comply with an individual's rights under the Act, including the right to access their personal data, the right to have inaccurate personal data rectified, the right to have personal data erased, the right to restrict processing, the right to data portability, and the right to object to processing.

  7. Process personal data for purposes other than those for which it was collected, unless the individual has given consent or there is another lawful basis for the processing.

  8. Process personal data in a way that does not ensure appropriate security of the personal data, including protection against unauthorized or unlawful processing and against accidental loss, destruction or damage, using appropriate technical or organizational measures.
